Rehabilitation measures include: (1) compensation at replacement cost without deduction for depreciation or salvage materials for houses and other structures; (2) priority given to in-kind compensation, for example, agricultural land-for-land of equal productive capacity acceptable to the displaced person; (3) transportation and subsistence allowances, and (4) business loss or income rehabilitation allowances. Displaced People (DPs) are those who, at the subprojects' cut-off date, are affected by the involuntary taking of land resulting in: relocation or loss of shelter; lost of assets or access to assets; loss of income sources or means of livelihood, whether or not the affected persons must move to another location. Also, people where the involuntary restriction of access to legally designated parks and protected areas resulting in adverse impacts on the livelihoods of the displaced persons are also considered displaced. There are 423 DPs losing residential land without structures built thereon. The DPs are entitled to the followings: compensation for loss of land in cash at 100 percent replacement cost to legal and legalizable land users. According to the results of the preliminary census survey, there are 423 DPs losing residential land with house or structures built thereon and the remaining land is sufficient for rebuilding house. Among them, 225 DPs have to rebuild main house on their remaining land. The DPs are entitled to the followings: compensation for loss of land in cash at 100 percent replacement cost to the legal and legalizable land users; if DPs have to rebuild their main house, the project will provide cash subsistence allowance of the value of 30kg of rice/person/months for the duration of 3 months. There are 39 DPs that will lose residential land with structures built thereon and have to be relocated to a new site. This resettlement action plan proposes measures to minimize land acquisition and losses during the design and construction phases of the project. Routes and substation options causing minimum impacts have been selected. Other likely impacts include: permanent impacts on trees, crops, and other assets in the proposed substations, tower foundations, and in the right-of-ways; assets on the service roads; all trees and crops or other assets surrounding the tower foundation and substation areas; and land temporarily acquired during project construction. Survey results show that thirty-five point nine (35.9) percent of the total affected area will be permanently affected, including land area for annual crops, garden areas, land for aquaculture, and public lands. There is no household losing more than 10 percent of their productive landholding. There will be 1330 households having houses or secondary structures impaired due to right-of-way of transmission lines. There are no households having business or commercial services to be affected. No impacts on natural preservation zones, vestigial remains, pagodas, or other sensitive areas are expected. No commune having ethnic minorities will be affected by subprojects. With the extent of impacts being mostly marginal, all displaced persons opt for cash compensation for their impacted land and assets at replacement costs or market rates. Development of resettlement sites is not required. All displaced persons to be resettled are entitled to transport allowance, relocation subsidy, training, or other income restoration measures. Those displaced persons losing more than 10 percent of their land holdings will be entitled to rehabilitation assistance and/or training. Mitigation measures include: a) minimize resettlement and land acquisition by considering and selecting most ultimate option; b) compensation, resettlement, and livelihood restoration programs should improve or at least maintain the living conditions of displaced persons (DPs) as those before the project and ensure their participation in the project; c) DPs must be supported adequately to be relocated with allowance for moving and other compensation with replacement price for affected house, land, and other assets; and d) effective and timely design, planning and implementation of resettlement options, and livelihood restoration measures must be carried out to avoid any unnecessary delays and disadvantages for DPs.
